A Regulation for the peace and good Government of the Dera Ghazi Khan Excluded Area, under section 92 of the Government of India Act, 1935

1.   Short title, extent and commencement.— (1) This Regulation may be called the Dera Ghazi Khan Excluded Area Laws Regulation, 1950.

      (2)  It shall extend to the Dera Ghazi Khan Excluded Area.

      (3)  It shall be deemed to have come into force on the date[2] when the Baluch Area was declared an Excluded Area.

2.   Definitions.— In this Regulation, unless the context otherwise requires—

          (i)  “Baluch Area” means the area lying beyond the western border of Dera Ghazi Khan district of the Punjab which was included in the Province of Punjab under the Governor-General’s Order No.2 of 1950, published under the Ministry of States and Frontier Regions, Notification No. F. 5(1)-F/50, dated: 13th April, 1950.[3]

          (ii)  “Dera Ghazi Khan Excluded Area” means the Baluch Area declared to be an Excluded Area, in the Ministry of States and Frontier Regions Notification No. D-2162-F/50, dated the 17th April, 1950.[4]

         (iii)  “Laws” mean Acts, Ordinances, Regulations, Rules, Bye-laws, Orders, Notifications or any other instruments issued thereunder.

3.   Cessation of the enforcement of certain laws.— All laws which came into force in the Baluch Area when that area became a part of he Province of the Punjab and before it was declared an Excluded Area shall, with effect from the date of the coming into force of this Regulation, cease to be in force in the Dera Ghazi Khan Excluded Area.

4.   Enforcement of Laws.— All such laws as were in force in the Baluch Area on the 14th day of August 1947, shall, as from the date of the coming into force of this Regulation, apply to the Dera Ghazi Khan Excluded Area.

5.   Savings.— Anything done, any investigation started or any legal proceeding instituted in the Baluch Area before the coming into force of this Regulation—

         (i)  under any law in force in that area on the 14th day of August 1947; or

        (ii)  under any law in force in that area from the date when that area was included in the Province of the Punjab till it was declared an excluded area;

and not inconsistent with any law made applicable to the Dera Ghazi Khan Excluded Area by this Regulation shall be deemed to have been done, started or instituted in the said Excluded Area under the corresponding provision of the law so made applicable in that Area by this Regulation.
