An ordinance to provide for the establishment

of the University of Education, Lahore.

 

Preamble. Whereas it is expedient to provide for the establishment of the University of Education, Lahore and for matters ancillary and connected thereto in the manner hereinafter appearing;

      And whereas the Provincial Assembly of the Punjab is dissolved and the Governor is satisfied that circumstances exist which render it necessary to take immediate action;

      And whereas under Article 4 of the Provisional Constitution (Amendment) Order No.9 of 1999, as amended by the Chief Executive Order No.11 of 2000, the Governor of a Province may issue and promulgate an Ordinance;

      Now, therefore, in exercise of the aforesaid powers and all other powers enabling him in that behalf, the Governor of the Punjab is pleased to make and promulgate the following Ordinance:-

 

Chapter I

Preliminary

1.   Short title and commencement. (1) This Ordinance may be called the University of Education, Lahore Ordinance, 2002.

      (2)  It shall come into force at once.

 

2.   Definitions.– In this Ordinance, unless there is anything repugnant in the subject or context–

      (a)  “Academic Council” means the Academic Council of the University;

  [2][(aa)  “affiliated college” means an educational institution affiliated to the University but not maintained or administered by it;]

      (b)  “Authority” means any of the Authorities of the University specified in section [3][18];

      (c)  “Chancellor” means the Chancellor of the University;

    [4][(d)  college” means a constituent or an affiliated college;]

[5][(dd)  “constituent college” means an educational institution maintained and administered by the University;]

      (e)  “Director” means a Director of a Division of the University;

      (f)  “Division” means a Division maintained and administered by the University or recognized by the University;

   [6][(ff)  “educational institution” means an institution imparting instructions in a subject or subjects of teacher education, training, research and the allied studies;]

      (g)  “Government” means the Government of the Punjab;

      (h)  officer” means an officer of the University specified in this Ordinance;

      (i)   prescribed” means prescribed by Rules, Statutes or Regulations;

      (j)   “Principal” means the head of a college;

  [7][(j-a)  ‘Pro Chancellor’ means the Pro Chancellor of the University;]

      (k)  “Professor Emeritus” means a retired Professor working in a Division or College in an honorary capacity;

      (l)   “Registered Graduate” means:-

                (i)  a graduate of the University who has his name entered in the register maintained for the purpose; or

               (ii)  a graduate of any University who ordinarily resides within the territorial jurisdiction of the University and has his name entered in the register maintained by the University for the purpose;

     (m)  “Research Associate” means a person engaged whole-time by the University for research, being equivalent in rank to a University teacher;

      (n)  “Statutes”, “Regulations” and “Rules” mean respectively the Statutes, the Regulations and the Rules made or deemed to have been made under this Ordinance;

      (o)  “teachers” means Professors, Associate Professors, Assistant Professors and Lecturers engaged whole-time by the University or by a Division or college for teaching degree, honours or post-graduate classes and such other persons as may be declared as teachers by Regulations;

      (p)  “University” means the University of Education, Lahore as constituted under this Ordinance;

      (q)  “Syndicate” means the Syndicate of the University; and

      (r)  “Vice Chancellor” means the Vice Chancellor of the University.

 

Chapter II

The University

3.   Incorporation.– (1) There shall be established a University to be called the University of Education, Lahore.

      (2)  The University shall consist of the Chancellor, the Vice Chancellor, members of the Syndicate and the Academic Council.

      (3)  The University shall be a body corporate having perpetual succession and a common seal and may by the aforesaid name sue and be sued.

      (4)  The University shall be competent to acquire and hold property both movable and immovable and to lease, sell or otherwise transfer any property which vests in or has been acquired by it.

 

4.   Powers of the University.– The University shall have the powers to–

      (a)  provide for instruction in such branches of teacher education, as it may deem fit and to make provision for research and for the advancement and dissemination of knowledge in such manner as it may determine;

      (b)  prescribe courses of studies to be conducted by its Divisions and the [8][colleges];

      (c)  hold examinations and to award and confer degrees, diplomas, certificates and other academic distinctions to and on persons who have been admitted to and have passed its examinations under prescribed conditions;

      (d) confer honorary degrees or other distinctions on approved persons;

      (e)  provide for such instruction, for persons not being students and fellows of the University as it may determine, and to grant certificates and diplomas to such persons;

      (f)  confer degrees on persons who have carried on independent research under prescribed conditions;

   [9][(ff)  affiliate or de-affiliate an educational institution;]

      (g)  admit educational institutions to its privileges and to withdraw such privileges under prescribed conditions;

      (h)  inspect Divisions or [10][colleges] and other educational institutions associated or seeking association with it;

      (i)   accept the examinations passed and the periods of study spent by students of the University at other Universities and places of learning as equivalent to such examinations and periods of study in the University, as it may determine, and to withdraw such acceptance;

      (j)   co-operate with other Universities and public authorities in such manner, and for such purposes as it may determine

      (k)  institute Professorships, Associate Professorships, Assistant Professorships and Lectureships and any other posts and to appoint persons thereto;

      (l)   create posts for research, publication, extension, administration and other related purposes and to appoint persons thereto;

      (m) recognize selected members of the teaching staff of colleges and Divisions or educational institutions admitted to the privileges of the University or such other persons as it may deem fit, as teachers;

      (n)  institute and award fellowships, scholarships, exhibitions, bursaries, medals and prizes under prescribed conditions;

      (o)  establish Divisions, Schools, Colleges, Departments, Centres, Museums and other centres of learning for the development of teacher education and research and to make such arrangements for their maintenance, management and administration as it may determine;

      (p)  control the residence of the students of the University and the colleges, to institute and maintain halls of residence, and to approve or license hostels and lodgings;

      (q)  supervise and control the discipline of the students of the University and the colleges, to promote the extra-curricular and recreational activities of such students and to make arrangements for promoting their health and general welfare;

      (r)  charge and receive such fees and other charges as it may determine;

      (s)  take disciplinary action against, and impose penalty on, students in the prescribed manner;

      (t)  make provisions for research and advisory services and with these objects to enter into arrangements with other institutions or with public bodies under prescribed conditions;

      (u)  enter into, carry out, vary or cancel contracts;

      (v)  receive and manage property transferred and grants, bequests, trusts, gifts, donations, endowments and other contributions made to the University and to invest any fund representing such property, grants, bequests, trusts, gifts, donations, and endowments or contribution in such manner as it may deem fit;

      (w) provide for the printing and publication of research and other works; and

      (x)  do all such other acts and things, whether incidental to the powers aforesaid or not, as may be requisite in order to further the objects of the University as a place of education, learning and research.

 

5.   Jurisdiction of the University.– (1) The University shall exercise the powers, conferred on it by or under this Ordinance within the territorial limits in the province of the Punjab and in respect of the [11][colleges]:

      Provided that Government may, in consultation with the University, by general or special order, modify the extent and scope of the aforesaid powers of the University with regard to such territorial limits or institutions.

      [12][(2) All Government Colleges of Education, the Government College for Elementary Teachers, Vehari, the Government College for Elementary Teachers, Joharabad and the Provincial Education Assessment Center, Lahore shall be the constituent colleges of the University.

      (3)  An asset and liability of a constituent college shall be the asset and liability of the University.

      (4)  An employee serving in a constituent college shall stand transferred to the University on the terms and conditions as may be determined by the Government:

      Provided that the terms and conditions shall not be less favorable than those admissible to him immediately before his transfer to the University.

      (5)  The University shall grant affiliation to a Government educational institution on the direction of the Government.]

      [13][(6)]  The University may admit to its privileges under prescribed conditions, an educational institution falling within the territorial limits of another University, whether inside or outside Pakistan; provided that the consent of such other University and the sanction of Government is first obtained.

 

6.   Integration of Educational Institutions with University and Transfer of Institutions from University to Government.– (1) Notwithstanding anything to the contrary contained in any other law, notification, contract, agreement or instrument, Government may, by notification in the official Gazette, integrate with the University any educational institution situated anywhere in the province or transfer any College, Division or Department of the University to Government.

      (2)  On the publication of a notification under subsection (1)–

            (a)  all rights, properties, assets and liabilities vested in or undertaken by Government or the University in respect of such educational institution, institute, institution or Department shall respectively become the rights, properties, assets and liabilities of the University or the Government, as the case may be; and

            (b)  all persons serving in connection with the affairs of such educational institution, institute, institution or Department in any capacity shall stand transferred for service under the University or Government, as the case may be, on such terms and conditions as Government may determine:

      Provided that such terms and conditions shall not be less favourable than those admissible to them immediately before their transfer to the University or Government.

      (3)  Any question arising under the provision to sub-section (2) shall be referred to Government and the decision of Government on such question shall be final.

7.   University open to all teachers and employees in the Government schools, colleges and other institutions.– The University shall be open to all teachers and employees in the Government schools, colleges and other institutions. Also the University shall be open to all persons of either sex and of whatever religion race, creed, class or colour and no person shall be denied the privileges of the University on the ground of religion, race, caste, creed, class or colour:

      Provided that nothing in this section shall be deemed to prevent religious instruction being given to the students in their own religious faiths in such manner as may be prescribed.

8.   Teaching in the University.– (1) All recognized teaching in various courses shall be conducted by the University or the constituent Colleges in the prescribed manner and may include lectures, tutorials, discussions, seminars, demonstrations as well as practical work in the laboratories, hospitals, workshops and farms, and other methods of instruction.

      (2)  The authority responsible for organizing recognized teaching shall be such as may be prescribed.

      (3)  The courses and the curricula shall be such as may be prescribed.

      (4)  A degree shall not be awarded to a student unless he has passed the examination in the subjects as may be prescribed.

      (5)  The provisions of sub-sections (3) and (4) shall take effect from such date as may be fixed by the Vice Chancellor.

 

Chapter III

[14][9.      Officers of the University.– The following shall be the officers of the University:-

         (a)  the Chancellor;

         (b)  the Pro Chancellor;

         (c)  the Vice Chancellor;

    [15][(ca)  the Pro-Vice Chancellor;]

         (d)  the Directors;

         (e)  the Principals of the constituent colleges;

          (f)  the Registrar;

         (g)  the Treasurer;

         (h)  the Controller of Examinations;

          (i)  the Librarian; and

          (j)  other persons as may be prescribed.]

 

10. Chancellor.– (1) The Governor of the Punjab shall be the Chancellor of the University.

      (2)  The Chancellor or his nominee shall preside at the convocation of the University.

      (3)  Where the Chancellor is satisfied that the proceedings of any Authority or the orders of any officer are not in accordance with the provisions of this Ordinance, the Statutes, the Regulations or the Rules, he may, after calling upon such Authority or officer to show cause why such proceedings or orders should not be annulled, by order in writing, annul such proceedings or orders.

      (4)  Every proposal to confer an honorary degree shall be subject to confirmation by the Chancellor.

      (5)  The Chancellor shall have the power to assent to such Statutes as are required to be submitted to him by the University or withhold assent or refer them back to the University for reconsideration.

      (6)  The Chancellor may remove any person from the membership of any Authority if such person–

            (a)  has become of unsound mind;

            (b)  has become subject to an incapacity which prevents him from functioning as a member of such Authority;

            (c)  has failed to attend three consecutive meetings of the Authority, without intimation to the Vice Chancellor;

            (d) remains absent from the country for more than six months without intimation to the Vice Chancellor; or

            (e)  has been convicted by a court of law of an offence involving moral turpitude:

      Provided that no order under this sub section shall be passed unless the person to be affected thereby is afforded an opportunity of being heard.

   [16][(7)  In the performance of his functions under this Ordinance, the Chancellor shall act and be bound in the same manner as the Governor of a Province acts and is bound under Article 105 of the Constitution of the Islamic Republic of Pakistan.]

 

11. Revisional powers of the Chancellor.– The Chancellor may, of his own motion or otherwise, call for and examine the record of any proceedings in which an order has been passed by any authority for the purpose of satisfying himself as to the correctness, legality or propriety of any finding or order and may pass such order as he may deem fit.

 

12. Visitation.– (1) The Chancellor may cause an inspection or inquiry to be made in respect of any matter connected with the University and shall, from time to time, appoint such person or persons as he may deem fit, for the purposes of carrying out inspection of–

      (a)  the University, its buildings, laboratories, libraries, museums, workshops and equipment;

      (b)  any institution, college or hostel maintained or recognized by or constituent to the University;

      (c)  the teaching and other work conducted by the University; and

      (d) the conduct of examinations held by the University.

      (2)  The Chancellor shall, in every such case, give notice to the Syndicate of his intention to cause an inspection or inquiry to be made under sub-section (1) and the Syndicate shall be entitled to be represented thereat.

      (3)  After the inspection or inquiry is completed, the Chancellor shall cause his views as a result thereof to be communicated to the Syndicate and after ascertaining the views of the Syndicate, the Chancellor shall advise the Syndicate to refrain from taking an action or to take such action, and within such time, as may be specified by the Chancellor.

      (4)  Where the Syndicate fails to carry out the advice of the Chancellor given under sub-section (3), the Chancellor may, after considering the explanation or representation, if any, made by the Syndicate, issue such directions as he may deem fit, and the Vice Chancellor shall comply with such directions.

 

[17][12-A. Pro Chancellor.– (1) The Minister for Education, Government of the Punjab, shall be the Pro Chancellor of the University.

      (2)  He shall perform such duties and functions and exercise such powers as may be assigned and delegated to him by the Chancellor.]

 

[18][13. Vice Chancellor.– (1) A person who is eligible and is not more than sixty five years of age on the last date fixed for submission of applications for the post of the Vice Chancellor may apply for the post.

      (2)  The Government shall determine, by notification in the official Gazette, the qualifications, experience and other relevant requirements for the post of the Vice Chancellor.

      (3)  The Government shall constitute, for a term of two years, a Search Committee consisting of not less than three and not more than five members for making recommendations for appointment of the Vice Chancellor.

      (4)  The Search Committee shall follow such procedure and criteria, for selection of the panel for the post of the Vice Chancellor, as the Government may, by notification, determine.

      (5)  The Search Committee shall recommend to the Government, in alphabetical order without any preference, a panel of three persons who, in its opinion, are suitable for appointment as the Vice Chancellor.

      (6)  The Chancellor shall appoint the Vice Chancellor for each term of four years but he shall serve during the pleasure of the Chancellor.

      (7)  The Government shall determine the terms and conditions of service of the Vice Chancellor.

      (8)  The incumbent Vice Chancellor shall not be allowed any extension in his tenure but subject to eligibility he may again compete for the post of the Vice Chancellor in accordance with the procedure prescribed by or under this section.

      (9)  If the office of the Vice Chancellor is vacant or the Vice Chancellor is absent or is unable to perform the functions of the Vice Chancellor owing to any cause, the Pro-Vice Chancellor shall perform the functions of the Vice Chancellor but, if at any time, the office of Pro-Vice Chancellor is also vacant or the Pro-Vice Chancellor is absent or is unable to perform the functions of the Vice Chancellor owing to any cause, the Chancellor shall make such temporary arrangements for the performance of the duties of the Vice Chancellor as he may deem fit.]

 

14. Powers and duties of the Vice Chancellor.– (1)The Vice Chancellor shall be the principal executive and academic officer of the University and shall ensure that the provisions of this Ordinance, the Statutes, the Regulations and the Rules are faithfully observed in order to promote teaching, research, publication, administration and the general efficiency and good order of the University. He shall have all powers necessary for this purpose including administrative control over all officers, teachers and other employees of the University.

      (2)  The Vice Chancellor shall, in the absence of the Chancellor, preside at a convocation of the University. He shall have all powers necessary for this purpose including administrative control over all officers, teachers and other employees of the University and shall preside at the meetings of the Authorities and other bodies of the University, Divisions and constituent Colleges of which he may or may not be the head.

      [19][(3) Subject to the conditions as may be prescribed, the Vice Chancellor may, in an emergency, take an action which is not otherwise in the competence of the Vice Chancellor but is in the competence of any other Authority.

      (3a)   The Vice Chancellor shall, within seven days of taking an action under sub-section (3), submit a report of the action taken to the Pro-Chancellor and to the members of the Syndicate; and, the Syndicate shall, within forty five days of such an action of the Vice-Chancellor, pass such orders as the Syndicate deems appropriate.]

      (4)  The Vice Chancellor shall also have the powers to–

            (a)  [20][* * * * * * * * * * *];

            (b)  sanction all expenditure provided for in the approved budget and to re-appropriate funds within the same major head of expenditure;

            (c)  sanction by re-appropriation an amount not exceeding one hundred and fifty thousand rupees for an unforeseen item not provided for in the budget and report it to the Syndicate at the next meeting;

            (d) appoint paper setters and examiners for all examinations of the University after receiving panels of names from the relevant Authorities;

            (e)  make such arrangements for the scrutiny of papers, marks and results as he may consider necessary;

            (f)  direct teachers, officers and other employees of the University to take up such assignments in connection with teaching, research, examinations, administration and such other activities in the University as he may consider necessary for the purpose of the University;

            (g)  delegate, subject to such conditions, if any, as may be prescribed, any of his powers under this Ordinance, to an officer or officers of the University;

            (h)  exercise general control and supervision over the system of examination of the University;

            (i)   exercise and perform such other powers and functions as may be prescribed;

            (j)   appoint visiting professors in various disciplines for a period not more than one academic year on the terms and conditions as prescribed; and

            (k)  appoint employees below the rank of lecturer or any equivalent officer.

 

[21][14-A.      Pro-Vice Chancellor.– (1) The Chancellor shall nominate the Pro-Vice Chancellor of the University, from amongst three senior most Professors of the University, for a term of three years.

      (2)  The Pro-Vice Chancellor shall perform such functions as may be assigned to him under this Ordinance, statutes or regulations.

      (3)  The Syndicate or the Vice Chancellor may assign any other functions to the Pro-Vice Chancellor in addition to his duties as Professor.]

 

[22][15. Registrar.– (1) The Chancellor shall appoint the Registrar of the University on the recommendation of the Government.

      (2)  The Government shall, for the purpose of recommending the appointment of the Registrar, consider a panel of three persons recommended by a Search Committee appointed by the Syndicate and headed by the Vice Chancellor.

      (3)  The Chancellor shall determine the terms and conditions of service of the Registrar on the recommendation of the Government.

      (4)  Subject to the general supervision of the Vice Chancellor, the Registrar shall–

                  (a)  be the custodian of the common seal and the academic records of the University;

                  (b)  maintain a register of the graduates of the University in the prescribed manner;

                  (c)  conduct election of an Authority in the prescribed manner;

                  (d) be the Secretary of the Syndicate, the Academic Council, Advanced Studies & Research Board, the Selection Board and the committees as may be prescribed; and

                  (e)  perform such other duties as may be prescribed.]

[23][15-A. Treasurer.– (1) The Chancellor shall appoint the Treasurer of the University on the recommendation of the Government.

      (2)  The Chancellor shall determine the terms and conditions of service of the Treasurer on the recommendation of the Government.

      (3)  The Treasurer shall–

            (a)  manage the property, the finance and the investment of the University;

            (b)  prepare the annual and revised budget estimates of the University and present the budget estimates to the Finance and Planning Committee and the Syndicate;

            (c)  ensure that the funds of the University are spent on the purposes for which they are provided;

            (d) be the Secretary of the Finance and Planning Committee; and

            (e)  perform other duties as may be prescribed.]

[24][15-B.   Controller of Examinations.– (1) The Chancellor shall appoint the Controller of Examinations of the University on the recommendation of the Government.

      (2)  The Government shall consider for the purpose of making the recommendation, a panel of three persons recommended by the Search Committee appointed by the Syndicate and headed by the Vice Chancellor.

      (3)  The Chancellor shall determine the terms and conditions of service of the Controller of Examinations on the recommendation of the Government.

      (4)  The Controller of Examinations shall conduct examinations of the University and perform other duties as may be prescribed.]

 

16. Resident Auditor.– (1) The Resident Auditor shall be taken from Audit Department of the Government on deputation on such terms and conditions as the Syndicate may determine.

 

17. Other officers.– Subject to the provisions of this Ordinance, the terms and conditions of service and the powers and duties of other officers of the University shall be such as may be prescribed.

 

Chapter IV

18. Authorities.– The following shall be the Authorities of the University–

      (a)  the Syndicate;

      (b)  the Academic Council;

      (c)  the Boards of Studies;

      (d) the Selection Committees;

      (e)  the Advanced Studies and Research Board;

      (f)  the Finance and Planning Committee;

      (g)  the Discipline Committee; and

      (h)  such other Authorities as may be prescribed by Statutes.

 

19. The Syndicate.– (1) The Syndicate shall consist of–

        (a)   the Vice Chancellor, who shall be its Chairman;

        (b)   the Chief Justice of the Lahore High Court, Lahore or his nominee from amongst the judges of the Lahore High Court;

           (c)    the Secretary to the Government of the Punjab, Education Department or his nominee not below the rank of Additional Secretary;

       (d)   the Secretary to Government of the Punjab, Finance Department, or his nominee not below the rank of Additional Secretary;

        (e)   the Chairman of the University Grants Commission or his nominee not below the rank of a whole time member of the Commission;

        (f)   one [25][female] Principal of a Constituent College to be nominated by the Chancellor on the recommendation of the Vice Chancellor;

        (g)   one Director of a Division of the University of Education to be nominated by the Chancellor;

        (h)   five eminent teacher educators (including one woman from the private sector educational institutions) to be nominated by the Chancellor; [26][* * *]

            (i)    one person of eminence to be nominated by the Chancellor [27][;] [28][* * *]

     [29][(j)   three members of the Provincial Assembly of the Punjab [30][including at least one female member of the Assembly] to be nominated by the Speaker of the Assembly [31][; and]

    [32][(k)   one Principal of an affiliated college to be nominated by the Chancellor on the recommendation of the Government.]

      (2)  Members of the Syndicate other than ex-officio members shall hold office for three years.

      (3)  The quorum for a meeting of the Syndicate shall be one-half of the total number of members, a fraction being counted as one.

 

20. Powers and duties of the Syndicate.– (1) The Syndicate shall be the executive body of the University and shall, subject to the provisions of this Ordinance and the Statutes, take effective measures to raise the standard of teaching, research and publication and other academic pursuits and exercise general supervision over the affairs and management of the property of the University.

      (2)  Without prejudice to the generality of the foregoing powers and subject to the provisions of this Ordinance and the Statutes, the Syndicate shall have the powers to–

                (a)   hold, control and administer the property and funds of the University;

            (b)  govern and regulate, with due regard to the advice of the Finance and Planning Committee in this behalf, the finances, accounts and investments of the University and for that purpose to appoint such agents as it may deem fit;

            (c)  consider and pass the annual report, the annual and revised budget estimates and to re-appropriate funds from one major head of expenditure to another;

            (d) transfer and accept transfer of movable or immovable property on behalf of the University;

            (e)  enter into, vary, carry out and cancel contracts on behalf of the University;

            (f)  cause proper books of accounts to be kept for all sums of money received and expended by the University and for assets and liabilities of the University;

            (g)  invest any money belonging to the University including any unapplied income, in any of the securities described in section 20 of the Trusts Act, 1882 (II of 1882), for the purchase of immovable property or in such other manner as it may determine, with the like power of varying such investments;

            (h)  receive and manage property transferred, grants, bequests, trusts, gifts, donations, endowments and other contributions made to the University and to administer funds placed at the disposal of the University for a specific purpose;

            (i)   administer funds placed at the disposal of the University for specified purposes;

            (j)   determine the form provided for the custody and regulate the use of the common seal of the University;

            (k)  provide the buildings, libraries, premises, furniture, apparatus, equipment and other means required for carrying out the work of the University and to establish and maintain halls of residence or approve or license hostels or lodgings for the residence of students;

            (l)   admit educational institutions to the privileges of the University and withdraw such privileges;

           (m)  arrange for the inspection of [33][colleges] and Divisions;

            (n)  institute Professorship, Associate Professorship, Assistant Professorship, Lecturership and other teaching posts or to suspend or to abolish such posts;

            (o)  create, suspend or abolish academic, administrative or research posts and give extension to such posts as may be necessary;

            (p)  appoint teachers and other officers on the recommendations of the Selection Board for teaching and other posts above the rank of lecturer or of the same rank;

            (q)  appoint Professor Emeritus on such terms and conditions as may be prescribed;

            (r)  confer with the approval of the Chancellor, honorary degrees in accordance with the conditions prescribed;

            (s)  prescribe the duties of officers, teachers and other employees of the University;

            (t)  suspend, punish and remove from service in the prescribed manner such officers, teachers and other employees as are appointed by the Syndicate;

            (u)  appoint members to the various Authorities in accordance with the provisions of this Ordinance;

            (v)  consider and approve Regulations recommended by the Academic Council;

            (w) approve Statutes and recommend those drafts of the Statutes for the approval of the Chancellor which pertain to the terms and conditions of the service of the University employees;

            (x)  regulate, determine and administer all other matters concerning the University and exercise all other powers in this behalf, not specifically mentioned in this Ordinance and the Statutes, but not inconsistent with the provisions of this Ordinance;

            (y)  delegate any of its powers to an Authority or officer or a committee or sub-committee; and

            (z)  perform such other functions as may be assigned to it by the other provisions of this Ordinance or the Statutes.

 

21. Academic Council.– (1) The Academic Council shall consist of–

      (a)  the Vice Chancellor (Chairman);

      (b)  all Principals of constituent colleges;

      (c)  all Directors of the Divisions;

   [34][(d)  all Professors of the University including Professor Emeritus;]

      (e)  three teachers [35][including at least one female teacher] educators nominated by the Syndicate;

      (f)  the Chairman of Punjab Textbook Board, Lahore;

      (g)  two persons [36][including at least one woman] from the private sector to be nominated by the Chancellor;

      (h)  two experts [37][including at least one female expert] in the field of education to be nominated by the Chancellor;

      (i)   two Executive District Officers (Education), one male and one female, to be nominated by the Secretary Education on the basis of academic performance; [38][* * *]

      (j)   one Chairman of a Board of Intermediate and Secondary Education of Punjab to be nominated by the Secretary Education [39][; and]

   [40][(k)  six Principals of the affiliated colleges to be nominated by the Chancellor on the recommendation of the Vice Chancellor.]

      (2)  Members appointed by nomination, other than ex-officio members, shall hold office for three years and if the office of any such member becomes vacant before the expiry of such term, such vacancy shall be filled in the prescribed manner.

      (3)  The number of members to constitute the quorum for a meeting of the Academic Council shall be one-third of the total number of members, a fraction being counted as one.

 

22. Powers and duties of the Academic Council.– (1)The Academic Council shall be the academic body of the University and shall, subject to the provisions of this Ordinance and the Statutes, have the powers to lay down proper standards of instruction, research, publication and examination and to regulate and promote the academic life of the University and the colleges.

      (2)  Without prejudice to the generality of the foregoing powers and subject to the provisions of this Ordinance and the Statutes, the Academic Council shall have the powers to–

            (a)  advise the Syndicate on academic matters;

            (b)  regulate teaching, research, publication and examinations;

            (c)  regulate the admission of students to the courses of studies and examinations in the University;

            (d) regulate the award of studentships, scholarships, medals, exhibitions and prizes;

            (e)  regulate the conduct and discipline of the students of the University;

            (f)  propose to the Syndicate scheme for the constitution and organization of Divisions, Colleges, Institutes, Centres and other academic bodies;

            (g)  consider or formulate proposals for the planning and development of teaching and research in the University;

            (h)  make Regulations on the recommendation of the Boards of Faculties and the Boards of Studies, prescribing the courses of studies, the Syllabi and the outlines of tests for all examinations provided that if the recommendations of a Board of Studies are not received by the prescribed date, the Academic Council may, subject to the approval of the Syndicate, continue for the next year the courses of studies already prescribed for an examination;

            (i)   recognize the examinations of other Universities or examining bodies as equivalent to the corresponding examinations of the University;

            (j)   frame Regulations for submission to the Syndicate;

            (k)  appoint members to the various Authorities in accordance with the provisions of this Ordinance; and

            (l)   perform such other functions as may be prescribed by Statutes.

 

23. Constitution, functions and powers of other Authorities.– The constitution, functions and powers of the Authorities for which no specific provision or insufficient provision, has been made in this Ordinance shall be such as may be prescribed by Statutes.

 

24. Appointment of Committees by Authorities.– Any Authority may, from time to time, constitute such standing, special or advisory committees as it may deem fit and may appoint such persons on these committees as are not members of the Authority appointing the committees.

 

Chapter V

Statutes, Regulations and Rules

25. Statutes.– (1) Subject to the provisions of this Ordinance, Statutes may be made to regulate and prescribe all or any of the following matters–

      (a)  the constitution of pension, insurance; gratuity, provident fund and benevolent fund for University employees;

      (b)  the scales of pay and other terms and conditions of service of officers, teachers and other employees of the University;

      (c)  the maintenance of the Register of Registered Graduates;

      (d) admission of educational institutions to the privileges of University and the withdrawal of such privileges;

      (e)  the conduct and discipline of officers, teachers, and other employees of the University;

      (f)  the constitution, power and duties of the Authorities and conduct of elections to such Authorities and relevant matters;

      (g)  the establishment of Academic Divisions, Centres, Institutes and Departments at the main campus of the University and at the constituent colleges;

      (h)  the powers and duties of officers, teachers and other employees of the University;

      (i)   conditions under which the University may enter into arrangements with other institutions or with public bodies for purposes of research and advisory services;

      (j)   conditions for appointment of Professors Emeritus and award of honorary degrees;

      (k)  efficiency and discipline of University employees;

      (l)   the general scheme of studies including the duration of courses and the number of subjects and papers for an examination; and

      (m) all other matters which, by this Ordinance, are to be or may be prescribed or regulated by Statutes.

      (2)  The draft of Statutes shall be proposed by the Syndicate to the Chancellor who may approve it with such modifications, or may refer it back to the Syndicate for reconsideration, or may reject it:

      Provided that–

         (i)  the Statutes affecting the constitution or powers of any Authority of the University shall not be proposed or approved until such Authority has been given an opportunity of expressing an opinion in writing upon the proposals;

        (ii)  the Statutes of clause (i) shall not be effective until it has been approved by the Chancellor; and

       (iii)  the Syndicate shall not have the power to make any Statutes concerning efficiency and discipline of officers, teachers and other employee of the University and such Statutes may be made by the Chancellor.

      (3)  Notwithstanding anything contained in sub-section(2), the Statutes set out in the Schedule shall be deemed to be statues framed under this section and shall remain in force until they are amended or repealed by Statutes framed in accordance with this section.

 

26. Regulations.– (1) Subject to the provisions of this Ordinance and the Statutes, Regulations may be made for all or any of the following matters–

      (a)  courses of studies for degrees, diplomas and certificates of the University;

      (b)  manner and method of teaching conducted in the university.

      (c)  admission of students to the University and conditions under which they are admitted or allowed to take courses and the examinations of the University and become eligible for the award of degrees, diplomas and certificates;

      (d) fees and other charges to be paid by students for admission to the courses of studies and the examinations of the University;

      (e)  conduct of examinations;

      (f)  conduct and discipline of students of the University;

      (g)  conditions of residence of the students of the University or colleges, including the levying of fees for residence in halls of residence and hostels and approval of hostels and lodgings for students;

      (h)  conditions for acquiring research degrees;

      (i)   institution of fellowships, scholarships, medals and prizes;

      (j)   institution of stipends and free and half-free studentships;

      (k)  academic costume;

      (l)   use of the Library;

      (m) formation of Divisions and Boards of Studies; and

      (n)  all other matters which by this Ordinance and the Statutes, are to be or may be prescribed by Regulations.

      (2)  The Regulations shall be prepared and submitted to the Syndicate, which may approve them with or without modifications or refer them back to the Academic Council for reconsideration or reject them.

      (3)  A Regulation shall not be valid, unless it has been approved by the Syndicate.

 

27. Rules.– The Authorities and the other bodies of the University may make Rules, consistent with this Ordinance, the Statutes and Regulations, to regulate the conduct of their business.

 

Chapter VI

University Fund

28. University Fund.– There shall be a fund of the University to be called the University Fund to which shall be credited all monies received by it from fees, donations, trusts, bequests, endowments, contributions, grants and all other sources.

 

29. Recovery of University dues.– The University or any person generally or especially authorized by it may apply to the Collector for recovery of any sum due to the University and the Collector shall thereupon proceed to recover the sum due, as if it were an arrear of land revenue:

      Provided that the University shall not take any action unless the person concerned is given an opportunity of being heard.

 

30. Audit and accounts.– (1) The accounts of the University shall be maintained in such form and in such manner as may be prescribed.

      (2)  No expenditure shall be made from the University Fund unless a bill for payment has, in prescribed manner, been audited by the Resident Auditor in conformity with the Statutes, Regulations and Rules.

      (3)  The accounts of the University shall be audited in the prescribed manner once a year by an Auditor appointed by the Government in this behalf.

      (4)  The annual statement of the accounts of the University signed by the Finance and the Resident Auditor, shall be submitted to the Government within six months of the closing of the financial year.

      (5)  The accounts of the University, together with audit objection, if any, in the prescribed manner, shall be presented to the Syndicate with the remarks of the Finance & Planning Committee.

 

Chapter VII

General Provisions

31. Retirement from service.– An officer, teacher or [41][other than the Chancellor, Pro-Chancellor and Vice Chancellor] other employee of the University shall retire from service–

      (a)  on such date, after he has completed twenty five years of service qualifying for pension or other retirement benefits as the Competent Authority may, in the public interest, direct, or

      (b)  when no direction is given under clause (a) on the completion of the sixtieth year of his age.

      Explanation: In this section, “Competent Authority” means the appointing authority or a person duly authorized by the appointing authority in that behalf, not being a person lower in rank to the officer, teacher or other employee concerned.

 

32. Opportunity to show cause.– Except as otherwise provided , no officer, teacher or employee of the University holding a permanent post shall be reduced in rank, or removed or compulsorily retired from service , unless he has been given a reasonable opportunity of showing cause against the action proposed to be taken against him.

 

33. Appeal and review.– (1) Where an order is passed punishing any officer, other than the Vice Chancellor, or any teacher or employee of the University or altering or interpreting to his disadvantage the prescribed terms and conditions of service, he shall, where the order is passed by the Vice Chancellor or any other officer or teacher of the University, have the right to appeal to the Syndicate against the order, and where the order is made by the Syndicate have the right to apply to the Chancellor for review of that order.

      (2)  The appeal or application for review shall be submitted to the Vice Chancellor who shall refer it to the Chancellor with such recommendation as the Vice Chancellor may consider necessary.

      (3)  No order on an appeal or application for review, as the case may be, shall be passed without affording to the appellant an opportunity of being heard.

 

34. Pension, insurance, gratuity, provident fund and benevolent fund.– (1) The University shall constitute for the benefit of its officers, teachers and other employees, in such manner and subject to such conditions as may be prescribed, such pension, insurance, gratuity, provident fund and benevolent fund schemes as it may deem fit.

      (2)  Where any provident fund has been constituted under this Ordinance the provisions of the Provident Funds Act, 1925 (XIX of 1925) shall apply to such fund as if it were the Government Provident Fund.

 

35. Commencement of term of office of Authorities.– When a member of a newly constituted Authority is elected, appointed or nominated, his term of office, as fixed under this Ordinance shall commence from such date as may be prescribed.

 

36. Filling of casual vacancies in Authorities.– Any casual vacancy among the elected, appointed or nominated members of any Authority shall be filled as soon as may be, by the person or the body who elected, appointed or nominated the member whose place has become vacant and the person elected, appointed or nominated to the vacancy shall be a member of such Authority for the residue of the term for which the person whose place he fills would have been a member.

 

37. Filling of vacancies in Authorities in certain circumstances.– Where a vacancy in the membership of an Authority cannot be filled because of–

      (a)  the office, the holder whereof was to be a member of the Authority ex-officio, having ceased to exist;

      (b)  the organization, institution or other body, other than the University having either ceased to exist or to function; or

      (c)  the occurrence of other circumstances in which it has become impracticable to fill the vacancy,

the vacancy shall be filled in such manner as the Chancellor may direct.

 

38. Disputes about membership of Authorities.– (1) Notwithstanding anything contained in this Ordinance, a person nominated or elected to an Authority shall cease to be a member of such Authority as soon as he ceases to hold the position by virtue of which he was elected, appointed or nominated.

      (2)  If a question arises whether any person is entitled to be a member of any Authority, the matter shall be referred to a committee consisting of the Vice Chancellor, the Secretary Education or his nominee not below the rank of Additional Secretary and the nominee of the University Grants Commission who are members of the Syndicate and the decision of the said committee shall be final.

 

39. Proceedings of Authorities not invalidated by vacancies.– No act, proceeding, resolution or decision of any Authority shall be invalid by reason only of the existence of any vacancy in, or any defect in the constitution of, the Authority.

 

40. Tripartite mobility.– Any officer, teacher of the Government or employee of the University on the recommendation of the Syndicate may be directed to serve in any post in the University under the Government or an educational research institution in the public interest:

      Provided that the terms and conditions offered to him shall not be less favorable than those enjoyed by him immediately before his services are placed at the disposal of the University and that full benefit of his previous service shall continue to remain in force until amended or repealed.

      (2)  The Government may, in consultation with the Selection Board place the services of an employee of the Government or any other University or an educational or research institution at the disposal of the University in the public interest:

      Provided that the terms and conditions offered to him shall not be less favorable than those enjoyed by him immediately before his services are placed at the disposal of the University and that full benefit of his previous service shall be allowed to him.

 

41. First Statutes.– Notwithstanding anything to the contrary contained in this Ordinance, the Statutes set out in the Schedule appended to this Ordinance shall be deemed to be the Statutes framed under section [42][25] of this Ordinance and shall continue to remain in force until amended or repealed.

 

42. Transitory provisions.– A Chancellor’s committee shall be constituted by the Chancellor on the recommendations of the Vice Chancellor to exercise the powers assigned to the Syndicate under this Ordinance till such time the Syndicate is constituted in accordance with the provisions of this Ordinance.

 

43. Removal of difficulties at the commencement of this Ordinance.– If any difficulty arises as to the first constitution or reconstitution of any Authority after the commencement of this Ordinance or otherwise in giving effect to the provisions of this Ordinance, the Chancellor may, on the recommendation of the Vice Chancellor, give appropriate directions to remove such difficulty.

 

Schedule

[Section 41]

The First Statutes of the

University of Education, Lahore

1.   Divisions.– The University shall include the following Faculties–

      (a)  Division of Arts and Social Sciences.

      (b)  Division of Science and Technology.

      (c)  Division of Islamic and Oriental Learning.

      (d) Division of Management and Administrative Science.

      (e)  Division of Education.

 

2.   Director/Principal.– (1) There shall be a Director/Principal of each Division/College, who shall be the Chairman and Convener of the Division/College.

      (2)  The Director/Principal of each Division/College shall be appointed by the Syndicate from amongst the three senior most Professors in the Division/College for a period of three years and shall be eligible for re-appointment for another three years:

      Provided that if no Professor is available in a Division/College, a Professor from some other Division or College may act as Director/ Principal till a Professor of the Division/College itself is appointed.

      (3)  The Director/Principal shall present candidates for admission to degrees except Honorary Degrees, in the course falling within the preview of the Division/College.

      (4)  The Director/Principal shall exercise such administrative and academic powers as may be delegated to him.

 

3.   Division and Directors.– (1) There shall be a Division for each subject or a group of subjects, as may be prescribed by Regulations and a Director shall head each Division.

      (2)  The Director of a Division shall be appointed by the Syndicate on the recommendation of the Vice Chancellor from amongst the three senior most Professors of the Division for a period of three years and shall be eligible for re-appointment:

      Provided that in a Division where there are less than three Professors the appointment shall be made from amongst the three senior most Professors and Associate Professors of the Division:

      Provided further that in a Division in which there is no Professor or Associate Professor, no such appointment shall be made and the Division shall be looked after by the Director/Principal of another Division with the assistance of the senior most teacher of the concerned Division.

      (3)  The Director of the Division shall plan, organize and supervise the work of the Division and shall be responsible for the entire academic and research affairs of the Division.

 

4.   Board of Studies.– (1) There shall be a separate Board of Studies for each subject or group of subjects, as may be prescribed by Regulations.

      (2)  Each Board of Studies shall consist of–

            (a)  the Director of Division/College (Chairman);

            (b)  all Professors and Associate Professors of the respective Division/College;

            (c)  the senior most Assistant Professor and Lecturer of the respective Division/College to be nominated by the Vice Chancellor; and

            (d) three eminent teacher educators of the respective Division/ College to be nominated by the Vice Chancellor.

      (3)  To supervise the academic affairs of the constituent colleges, in particular for the subject not to be taught at a University, Academic Division/College and in-service courses to be organized at these constituent colleges, there shall be a Board of Studies consisting of–

            (a)  the senior most Principal from the concerned Colleges (Chairman);

            (b)  all Professors and Associate Professors from the concerned Colleges;

            (c)  the senior most Assistant Professor and the Lecturer from the concerned Colleges; and

            (d) two experts including at least one senior member of the concerned University Academic Division/College to be nominated by the Vice Chancellor.

      (4)  The term of office of members of the Board of Studies, other than ex-officio members, shall be three years.

      (5)  The quorum for meetings of the Board of Studies shall be one-half of the number of members, a fraction being counted as one.

      (6)  The Chairman of the University Division concerned shall be the Chairman and Convener of the Board of Studies, and in respect of a subject where there is no University Division, the Chairman shall be appointed by the Syndicate.

      (7)  The functions of the Board of Studies shall be to–

            (a)  advise the Authorities on all academic matters connected with instruction, publication, research and examination in the subject or subjects concerned;

            (b)  propose curricula and syllabi for all degree, diploma and certificate courses in the subject or subjects concerned;

            (c)  suggest a panel of names of paper setters and examiners in the subject or subjects concerned; and

            (d) perform such other functions as may be prescribed by Regulations.

 

5.   Board of Advanced Studies and Research.– (1) The Advanced Studies and Research Board shall consist of–

      (a)  the Vice Chancellor (Chairman);

      (b)  the Directors of Divisions/Principals of constituent colleges;

      (c)  three University Professors other than Directors and Principals to be appointed by the Syndicate;

      (d) three University teachers having research qualifications and experience to be appointed by the Academic Council; and

      (e)  three teachers from constituent colleges having research qualifications to be appointed by the Academic Council.

      (2)  The term of office of members of the Advanced Studies and Research Board, other than ex-officio members, shall be three years

      (3)  The quorum for a meeting of the Advanced Studies and Research Board shall be one-half of the total number of members, a fraction being counted as one.

 

6.   Selection Board and Committees.– (1) There shall be a Selection Board to appoint all kinds of academic, research and administrative staff in Division and College of BS-17 or above, and shall consist of–

      (a)  the Vice Chancellor;

      (b)  nominee of the Chief Justice, Lahore High Court, Lahore;

      (c)  three teacher educators nominated by the Chancellor, one of whom shall be a woman;

      (d) a nominee of the Syndicate;

      (e)  the Principal of the College or the Director of Division concerned; and

      (f)  one expert of the relevant field to be nominated by the Vice Chancellor.

      (2)  There shall be a Selection Committee-I to appoint all non-teaching or technical staff from BS-11 to BS-16 and shall consist of–

            (a)  the Principal of the College or Director of the Division/ College other than the concerned Division/College as Chairman, to be nominated by the Vice Chancellor;

            (b)  the Principal of the College or Director of the Division/ College concerned;

            (c)  a nominee of Secretary Education not below the rank of Deputy secretary;

            (d) a nominee of the Syndicate; and

            (e)  one expert of the relevant field to be nominated by the Director of the Division/College concerned.

      (3)  There shall be a Selection Committee-II, to appoint non-teaching, technical and supporting staff from BS-1 to BS-10 in the College and Division and shall consist of–

            (a)  the Principal of the College concerned;

            (b)  the two senior most professors of the concerned Division or College;

            (c)  [43][Registrar] Division or his nominee in the relevant field; and

            (d) a nominee of the Syndicate.

      (4)  The members mentioned in clause (d) of sub paragraphs (1), (2) and (3) shall hold office for two years.

      (5)  The quorum of Selection Board and Committee in case of selection of a Professor or an Associate Professor and other teachers shall be four and three respectively. In case of selection of officers, other than teachers, the Selection Board shall consist only of members mentioned at (a), (b), (c) and (f) of sub paragraph (1) and the quorum shall be three.

      (6)  No member who is a candidate for the post to which appointment is to be made shall take part in the proceedings of the Board.

      (7)  In selecting candidates for the posts of Professors and Associate Professors, the Selection Board shall co-opt or consult three experts in the subject concerned and in selecting candidates for other teaching posts, two experts in the subject concerned, to be nominated by the Vice Chancellor from a standing list of experts for each subject approved by the Syndicate on the recommendation of the Selection Board and revised from time to time.

 

7.   Functions of the Selection Board and Committee.– (1) The Selection Board and Committee for teaching and other posts shall consider the applications received in response to advertisement and recommend to the Syndicate the names of suitable candidates for appointment to teaching or other posts, as the case may be, and may also recommend–

      (a)  the grant of a higher initial pay in a suitable case for reasons to be recorded; or

      (b)  the appointment of an eminently qualified person to a Professorship in the University on terms and conditions other than those prescribed.

      (2)  In the event of difference of opinion between the Selection Board or Committee and the Syndicate, the matter shall be referred to the Chancellor whose decision thereon shall be final.

 

8.   Finance and Planning Committee.– (1) The Finance and Planning Committee shall consist of–

      (a)  the Vice Chancellor (Chairman);

      (b)  one member of the Syndicate to be appointed by the Syndicate;

      (c)  one member of the Academic Council to be appointed by the Academic Council;

      (d) two nominees of the Chancellor, one each from Education Division and Finance Department;

      (e)  one Principal of the College to be nominated by the Syndicate; and

      (f)  the [44][Registrar].

      (2)  The term of office of the appointed members shall be three years.

      (3)  The quorum for a meeting of the Finance and Planning Committee shall be three members.

 

9.   Functions of the Finance and Planning Committee.– (1) The functions of the Finance and Planning Committee shall be to–

      (a)  consider the annual statement of accounts and the annual and revised budget estimates and advise the Syndicate thereon;

      (b)  review periodically the financial position of the University;

      (c)  advise the Syndicate on all matters relating to planning, development, finances, investments and accounts of the University; and

      (d) perform such other functions as may be prescribed.

 

10. Discipline Committees.– (1) The University Discipline Committee shall consist of–

      (a)  the Chairman to be nominated by the Vice Chancellor;

      (b)  two Professors to be nominated by the Academic Council;

      (c)  one member to be nominated by the Syndicate; and

      (d) the teacher or officer incharge of students affairs by whatever name called (Member/Secretary).

      (2)  The College Discipline Committee shall consist of–

            (a)  the Principal of the College (Chairman);

            (b)  three senior most teachers of the College; and

            (c)  the teacher incharge of students affairs.

      (3)  The term of office of the members of the Committees, other than ex-officio members, shall be two years.

      (4)  The quorum for a meeting of the Discipline Committee shall be three and two members respectively.

      (5)  The functions of this Committee shall be to–

            (a)  propose Regulations to the Academic Council relating to the conduct of University students, maintenance of discipline and breach of discipline; and

            (b)  perform such other functions as may prescribed.
