An Act
It is necessary to
repeal the Punjab Khal Panchayat Act 2019 (XXV of 2019) for the purposes
hereinafter appearing.
Be it enacted by
Provincial Assembly of the Punjab as follows:
1. Short
title and commencement.-
(1) This Act may be cited as the Punjab Khal Panchayat (Repeal) Act 2025.
(2) It shall
come into force at once.
2. Repeal
and saving.- (1) The
Punjab Khal Panchayat Act 2019 (XXV of 2019) is hereby repealed.
(2) Notwithstanding
the repeal of the Punjab Khal Panchayat Act 2019 (XXV of 2019), all the
proceedings and processes pertaining to powers and duties as prescribed under
section 10 of the Punjab Khal Panchayat Act 2019 (XXV of 2019), any auctions
done, sanction orders issued, any appointment made, order passed, notification
issued, contracts executed, rights acquired, liabilities incurred, possession
of properties delivered and proceeding initiated before various courts or other
forums and thing done or action taken under any provision of repealed Act shall
continue to have effect as if the said law has not been repealed.
3. Transition.-
(1) All the properties, both urban and rural, including agricultural land,
whether occupied and unoccupied, placed at the disposal of defunct Punjab Khal
Panchayat Authority (PKPA), which may be available for disposal immediately
before the repeal of the aforesaid Act, shall stand transferred to the
Irrigation Department of the Government.
(2) Out of
the 197 employees:
(a)
50 vacant positions will be abolished.
(b)
04 contract employees will have their contracts terminated.
(c)
69 employees will be absorbed into the Surplus Pool of the Services and
General Administration Department of the Government for further placement.
(d)
remaining employees will be absorbed by the Irrigation Department of the
Government.
(e)
07 OSD posts for in-service death will also be adjusted in the
Irrigation Department of the Government accordingly.
(3) The Pension Fund and G.P.
Fund contributions of the Punjab Khal Panchayat Authority employees will be
transferred to the Finance Department of the Government and shall be adhere to the pension regime applicable at the time of
the employees' regularization.
