An Act to amend the Co-operative Societies (Reforms) Order, 1972 (P.O. No. 9 of 1972), in its application to the Province of the Punjab

Preamble.— WHEREAS it is expedient to amend the Co-operative Societies (Reforms) Order, 1972 (P.O. No. 9 of 1972), in its application to the Province of the Punjab, in the manner hereinafter appearing.

      It is hereby enacted as follows:-

1.   Short title, extent and commencement.— (1) This Act may be called the Co-operative Societies (Reforms) Order (Punjab Amendment) Act, 1973.

      (2)  It shall extend to the whole of the Province of the Punjab.

      (3)  It shall come into force at once.

2.   Amendment of Article 5 of P.O. 9 of 1972.— (1) In the Co-operative Societies (Reforms) Order, 1972 (P.O. No. 9 of 1972) (hereinafter referred to as the said Order), in its application to the Province of the Punjab, in Article 5, in clauses (1) and (3), for the figure “12”, the figure “24” shall be substituted.

      (2)  In the said Order, in its application to the Province of the Punjab, in Article 5, for the existing clause (5) and clause (6), the following shall respectively be substituted, namely:-

            “(5)  If the number of members of the committee of a society ceasing to hold office in pursuance of clause (2) is more than one-third of the total number of members of the committee, the committee shall stand superseded and all members of the committee shall vacate their seats and the affairs of the society shall be managed, and all the powers and functions of the committee shall be exercised and performed by an administrator to be appointed by the registrar to hold office until the persons elected as members of the committee at the election held in pursuance of clause (6) have assumed office.

              (6)  Where the committee of a society stands superseded in pursuance of clause (5), another committee shall be constituted by election in a general meeting of the society to be called by the registrar on a date between the first day of February, 1973 and the 30th day of April, 1973.”

3.   Proceedings already taken and rights accrued to be ineffective.— Notwithstanding anything to the contrary contained in the order, no right shall be deemed to have accrued to any person by virtue of any election proceedings taken, before the coming into force of the Co-operative Societies (Reforms) Order (Punjab Amendment) Ordinance, 1972 (Punjab Ordinance No. XX of 1972), under the Order.

4.   Repeal.— The following enactments are hereby repealed:-

      (1)  The Co-operative Societies (Reforms) Order (Punjab Amendment) Ordinance, 1972 (Punjab Ordinance No. XX of 1972).

      (2)  The Co-operative Societies (Reforms) Order (Punjab Amendment) Ordinance, 1973 (Punjab Ordinance No. III of 1973).
